The Website is operated by MY EV (PRIVATE) LIMITED (NTN E628948), a company incorporated under the laws of Pakistan, having its registered address at 27-KM, MULTAN ROAD, INDUSTRIAL AREA, ROHINALA, MOHLANWAL, Lahore, Pakistan. (referred to herein as "MY EV", "we", "us", or "our").
1.2. Changes to Terms:
We reserve the right to modify these T&Cs at any time. Any changes will be effective immediately upon posting the revised T&Cs on the Website. Your continued use of the Website after any such changes constitutes your acceptance of the new T&Cs.
1.3. Eligibility:
By using this Website, you represent that you are at least eighteen (18) years of age and capable of entering into a legally binding agreement in Pakistan.
2. Intellectual Property Rights (IP)
2.1. Ownership:
The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by MY EV (PRIVATE) LIMITED, its licensors, or other providers of such material and are protected by intellectual property laws of Pakistan and international treaties.
2.2. Trademarks:
The "MY EV" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MY EV or its affiliates or licensors. You must not use such marks without the prior written permission of MY EV.
2.3. Limited License:
You are granted a non-exclusive, non-transferable, revocable license to access and use the Website strictly in accordance with these T&Cs for non-commercial purposes only.
3. Product Information and Pricing
3.1. Accuracy of Content:
We strive to ensure that the product descriptions, images, and specifications displayed on the Website are accurate. However, MY EV does not warrant that the content is complete, reliable, current, or error-free. The actual colour, appearance, and features of the Products (electric motorcycles and scooters) may vary from what is displayed on your screen.
3.2. Maximum Retail Price (MRP):
Any price displayed on the Website represents the Maximum Retail Price (MRP) for the Products. This is the ceiling price at which the Product must be sold to the end consumer by our authorized dealers in Pakistan, as per the MY EV Dealership Policy Manual (Section 3.5). The final transaction price and applicable local taxes will be determined by the authorized dealer at the time of purchase.
3.3. Product Availability:
The display of Products on the Website does not guarantee their availability for immediate purchase. All Products are subject to stock availability and may vary by location and authorized dealer.
4. Online Services, Bookings, and Sales Disclaimer
4.1. Non-Binding Information:
The Website and its services (including, but not limited to, model configuration, dealer location searches, and general inquiries) are provided for information purposes only.
4.2. Online Booking/Inquiry:
Any form submission, inquiry, or online pre-booking made through the Website is considered a non-binding request for contact or pre-order. It does not constitute a sale, a promise of delivery, or a guarantee of a specific price or product allocation.
4.3. Sales Transactions:
The actual sale and purchase agreement for any Product is solely between you and an independent Authorized MY EV Dealer. MY EV acts as the Principal and Brand Owner but does not directly sell Products to the end consumer. All terms of sale, delivery timelines, final pricing, and vehicle registration are governed by the contract executed between you and the Authorized Dealer.
4.4. Warranty:
Product warranties are provided by MY EV (PRIVATE) LIMITED through its authorized dealer network, subject to the terms and conditions outlined in the official Warranty Policy provided at the time of vehicle purchase. No warranty, express or implied, is given regarding the Website itself.
5. Website Usage and Prohibited Conduct
5.1. Permitted Use:
You may use the Website only for lawful purposes and in accordance with these T&Cs.
5.2. Prohibited Conduct:
You agree not to use the Website:
a. In any way that violates any applicable local, national, or international law or regulation of Pakistan, including laws related to electronic transactions or consumer protection.
b. To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
c. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm MY EV or users of the Website.
d. To engage in "web scraping," "data harvesting," or any similar automated data gathering and extraction methods without our express written permission.
6. Limitation of Liability and Indemnification
6.1. Limitation of Liability:
In no event will MY EV, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Website, any websites linked to it, any content on the Website or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages.
6.2. Indemnification:
You agree to defend, indemnify, and hold harmless MY EV, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these T&Cs or your use of the Website.
7. Governing Law and Jurisdiction
7.1. Governing Law (Pakistan):
These Terms and Conditions and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Pakistan, without giving effect to any choice or conflict of law provision or rule.
7.2. Jurisdiction:
Any legal suit, action, or proceeding arising out of or related to these T&Cs or the Website shall be instituted exclusively in the courts of Lahore, Pakistan, although we retain the right to bring any suit, action, or proceeding against you for breach of these T&Cs in your country of residence or any other relevant country.
